These Terms of Service ("Terms") govern your use of the website and referral program operated by Aari Referrals LLC ("Aari," "we," "us," or "our"), a Florida licensed real estate brokerage (License CQ1073724). By using this website or applying to join the referral program, you agree to these Terms. If you do not agree, do not use the site.
The referral program is open only to individuals who are at least 18 years old and hold an active Florida real estate license in good standing. By joining, you represent that you meet these requirements and that the information you provide is true and accurate.
If you join as a referral associate, your relationship with Aari is governed by the Referral Associate Agreement (RAA), the Commission Structure Addendum (CSA), and Exhibit A (Fee Schedule), which you sign at onboarding. Those documents control all matters of authority, conduct, supervision, compensation, and termination. If anything in these Terms conflicts with the RAA, the RAA controls for the referral relationship.
Membership is offered on a monthly plan ($25 per month, with a first payment that includes the annual fee) or an annual prepaid plan ($375 per year), as described at signup and in Exhibit A. Fees are billed through our third party payment processor and are non-refundable once charged, except as expressly stated in Exhibit A. Other fees, including late payment and returned payment fees, may apply as set out in Exhibit A.
Recurring membership fees are charged automatically on the billing cycle you select until you cancel or your affiliation ends. You authorize us and our payment processor to charge your selected payment method. You are responsible for keeping your payment and contact information current. Referral payouts owed to you are paid by the method you designate, subject to the conditions in the RAA, CSA, and Exhibit A.
You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, scraping or copying content without permission, or using it for any unlawful purpose. We may suspend or restrict access for conduct that violates these Terms.
The Aari name, logo, branding, content, and materials on this site are owned by Aari Referrals LLC and may not be used, copied, or distributed without our prior written consent. Your affiliation does not transfer any ownership of our intellectual property.
Aari makes no representation or guarantee regarding the number of referral opportunities, the likelihood that any referral will close, the amount of any referral fee, or any earnings. Any figures, examples, or illustrations on this site or in our materials are for illustration only and do not create entitlement, minimum earnings, or guarantees. Referral compensation is earned only when the conditions in the RAA, CSA, and Exhibit A are satisfied.
The website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error free, or secure.
To the fullest extent permitted by law, Aari Referrals LLC and its officers, managers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising from your use of the site or participation in the program. Nothing in these Terms limits liability that cannot be limited under applicable law. Liability relating to the referral relationship is governed by the RAA.
You agree to indemnify and hold harmless Aari Referrals LLC and its officers, managers, and agents from claims, damages, and expenses arising from your use of the site, your violation of these Terms, or your violation of any law or third party right, consistent with the indemnification provisions of the RAA.
We may suspend or terminate your access to the site or program for violation of these Terms or the RAA. Termination of the referral relationship is governed by the RAA. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute shall be resolved as provided in the RAA, including mediation and binding arbitration in Lee County, Florida, with venue for any court proceeding in Lee County, Florida.
By using this site and providing your information, you consent to receive communications electronically and agree that electronic signatures, agreements, and records are legally binding under the federal E-SIGN Act and the Florida Uniform Electronic Transaction Act.
We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the "Last updated" date above. Your continued use of the site after changes are posted constitutes acceptance.
